Legal threat to federal plans 25 May 2007
The federal government plan to take over control of water in the Murray-Darling basin could be under threat from a legal challenge by a group of irrigators who claim that the state and federal governments have stripped them of ground water rights without fair compensation. The irrigators are relying on section 100 of the constitution which says that the commonwealth is not allowed to diminish the rights of states or residents to use water for conservation or irrigation. If successful, the action could force the government to conduct a referendum to carry out its planned water take-over.
